When a car accident occurs, most people believe they are only entitled to insurance payouts to cover the cost of car damage and routine medical costs that resulted from the accident. In fact, if someone is injured in an auto accident, they may be able to file a personal injury lawsuit if they suffer from physical, emotional, or mental damages from the incident.

Immediately after a car accident, it is important to document everything that occurred. Photographs and written accounts are excellent ways to keep track of details. If there are any witnesses, gather their statements and contact information for referral. Obviously, it is also necessary to exchange information with any other drivers involved in the accident including name, phone number, email address, and auto insurance policy number. If the police are present, get their names and contact information to follow up and get a copy of the police report. Many drivers choose to contact their auto insurance companies from the scene of the accident before proceeding further.

Drivers do not need to admit fault at the scene of the accident. They should also seek medical care immediately and follow through on all treatment plans.

After an accident, anyone who has been injured should keep meticulous records if they have the intention of filing a personal injury lawsuit. They should document evidence such as:

· Medical expenses – hospital charges, doctor visit co-pays, prescriptions, physical therapy, lab tests, and x-rays; these can be especially costly if the patient has limited or no health insurance

· Personal expenses – lost income as a direct result of taking time off work to handle medical treatment; documentation from employers will add credibility to this claim

· Other costs – auto repair and replacement transportation

· Personal issues – missing time from school, emotional distress, pain and discomfort, fatigue, and other inconveniences can be a direct result of a personal injury sustained in a car accident.
