A DUI is a very serious offense and the penalties can be harsh and long lasting. People with one or more DUIs on their records might face future problems with employment or securing financial resources such as a home loan. Washington state recognizes the legal blood alcohol content (BAC) limit as 0.08 percent. For commercial drivers, the limit is lower at 0.04 percent; for drivers under the legal drinking age of 21, the limit is 0.02 percent. Drivers should be aware that they can be charged with a DUI even if their BAC is under the legal limit if they are exhibiting the behaviors of an intoxicated driver. In addition to alcohol, driving under the influence also includes illegal drugs or a prescription drug that causes unsafe driving.

The punishment for a first offense DUI often includes: jail, from 24 hours to one year; fines from $865 to $5000; license suspension from 90 days to one year; the installation of an ignition interlock device at the driver‘s expense; and treatment through a drug or alcohol education program.

For a second offense, everything - jail time, fines, license suspension - is increased. The driver will have their license suspended for two years. For a third offense, the defendant will likely have jail time and of course a license suspension, this time for three years. Everyone who reapplies for their license after the suspension period must submit a Washington SR22 insurance form and will face much higher auto insurance rates.

Like many other states, Washington adheres to the implied consent law. This means that drivers agree to submit to a chemical test to check their alcohol level any time they are pulled over by an officer with probable cause. Refusing the test will result in a license suspension for one year. Drivers imply their consent by the simple act of operating a vehicle in the state.
