Felonies and misdemeanors are both types of crimes; the terms are used to categorize different types of criminal charges. Felonies are more serious than misdemeanors and carry harsher penalties. In general, felony convictions will result in a prison sentence of at least one year, while misdemeanors usually require probation or limited jail time of less than one year. In Illinois, there are five classes of felonies and three classes of misdemeanors.
Class X Felony - this is the most serious felony class; a conviction usually results in 6 to 30 years in prison (state penitentiary) and fines of up to $25,000; an example is an aggravated criminal sexual assault
Class 1 Felony - a sentence of 4 to 15 years in prison and fines of up to $25,000 can result; examples are criminal sexual assault or possession of cocaine or heroin
Class 2 Felony - results in 3 to 7 years in prison and fines of up to $25,000; an example is arson
Class 3 Felony - convict will face 2 to 5 years in prison and fines of up to $25,000; an example is aggravated battery
Class 4 Felony - between 1 and 3 years in prison and fines of up to $25,000; examples are aggravated assault or stalking.
Of course, these are all just guidelines and the individual sentences will depend upon the circumstances of the crime and number of offenses. A repeat offender is likely to receive stricter sentences than a first time offender. Murder and manslaughter convictions have their own guidelines that are separate from felony classes.
Class A Misdemeanor - this is the most serious class; up to 1 year in jail and fines of up to $2,500 can result; examples include DUI or possession of firearms
Class B Misdemeanor - up to 6 months in jail and fines of up to $1,500; examples include possession of marijuana between 2.5 and 10 grams or harassment
Class C Misdemeanor - up to 30 days in jail and fines of up to $1,500; examples include assault or possession of marijuana under 2.5 grams.
