Many states such as Illinois have a point system for keeping track of traffic violations on driving records. Careful drivers with perfect records have zero points, while drivers who commit infractions have demerit points added to their records. The value of the points varies according to the severity of the traffic violation. In Illinois, the points system is standardized and set by the Secretary of State of Illinois, and is an internal designation only - in other words, the courts do not directly set or adjust points.
Examples of Illinois traffic violations and their level of seriousness, from high to low, include:
· Reckless driving
· Speeding
· Tailgating or following too closely
· Leaving the scene of an accident that involves personal injury
· Running a red light
· Failure to follow traffic signs such as a stop sign
· Failure to yield to emergency vehicles or a school bus
· Improper passing
· Improper lane usage, such as driving under the speed limit in the left passing lane or not allowing drivers to pass in the left lane
· Improper merging into traffic (i.e. “cutting” someone off)
· Failure to yield right of way at an intersection or to pedestrians in a crosswalk.
Points for speeding will vary depending on how many miles per hour the driver was over the speed limit. Illinois is unique by giving points to drivers who are cited for driving too slowly on a freeway.
If a driver accumulates an excessive number of points on their driving record, they can face many penalties including license suspension. The length of the suspension will depend upon many factors, including any prior license suspensions of the driver and also the exact number of points on their record.
Reinstating a license can be costly, time consuming, and frustrating. Many drivers depend upon their cars for getting to work, school, and for family obligations. Not every city or town has reliable public transportation, so losing a license can be devastating to a driver. Every driver should know the state of their driving record and can order a copy from the Illinois Secretary of State.
Drivers who are facing serious consequences from traffic violations are encouraged to seek the help of an experienced Illinois traffic attorney. Lawyers who focus on traffic law are best equipped to successfully contest traffic tickets and help motorists keep their records clean.
