New California Driving Laws Target DUI Offenses in 2010

It's a new year with new upcoming driving laws that will be enforced this summer for California drivers who receive DUIs.

Starting on July 1, all California drivers who are convicted of a DUI will have to install an ignition interlock device on their vehicles to get a restricted California license. These devices are mini-breathlyzers installed on the dashboard in a vehicle that would prevent a car from operating until a motorist provides an alcohol-free breath sample. The device is not larger than a cell phone. As one drives down the road, he or she will have to provide breath samples to make sure there is no alcohol in his or her system.

Even if a person receives a first-offense DUI, he or she will still have to install the IID in a car to receive a restricted license. An issued restricted license will let motorists only drive to and from work, school and court-ordered DUI alcohol and drug education program. This pilot program will first be enforced in Los Angeles, Tulare, Alameda and Sacramento.

An additional driving law that will be enforced on July 1 affects DUI offenders. Beginning this summer, the Department of Motor Vehicles must inform second-time DUI offenders that they can get a restricted license after 90 days of license suspension. Third-time DUI offenders must be informed by the DMV that they can get a restricted license after a 6 month suspension. For drivers to be able to obtain the licenses, they must first enroll in a DUI program. Also, they have to install and use an IID in their cars.

IIDs are growing popular in California because of recent studies from the International Council on Alcohol, Drugs and Traffic Safety that report that DUI offenses are lowered when the device is installed in the car. The report states that the combination of IIDs, monitoring and a service program results in a decrease of 40-95% in repeat drunk driving occurences.
