Many people have heard the term “reckless driving” but do not understand exactly what it is. Reckless driving is when a person drives with no consideration to the safety of others, whether the other people are in a car or on the street. It can also apply to reckless consideration of property. Although speeding or driving under the influence (DUI) can be dangerous to others, these are different types of violations. An example of reckless driving is driving dangerously on a ramp or hill with the intention of making the car airborne.
Aggravated reckless driving is a more serious violation; this is when a driver causes severe physical harm to another person or causes them to become disabled.
Reckless driving is a Class A Misdemeanor. Generally, the penalties for this crime are up to one year in jail and a fine of up to $2,500. Aggravated reckless driving is a Class 4 Felony and can result in up to 3 years in prison and a fine of up to $25,000. If any type of reckless driving results in harm to a child or school crossing guard, the penalties will be more severe.
In Illinois, street racing is recognized as reckless driving. This occurs when two cars are racing or competing down a street, either by driving at the same time or going individually and being timed. If two cars attempt to reach the same destination by racing, that is also illegal. Using a vehicle to block another vehicle from passing is also street racing. Another form of street racing is testing the endurance of a driver on long distances. If street racing results in severe physical harm to someone, it is aggravated street racing, a Class 4 Felony. Street racing is a Class A Misdemeanor for a first offense and a Class 4 Felony for a second offense.
Attempting to elude a police officer is considered reckless driving. Drivers must always pull over as soon as safely possible if they see an officer with flashing lights behind them. This type of violation will usually result in a license suspension.
