In Illinois, only the Secretary of State (SOS) can suspend driver's licenses. Drivers need to be aware of their license status by ordering a copy of their driving record. In Illinois, this may be done either at a local SOS office or by sending a request through the mail. Drivers must provide their name, date of birth, and driver’s license number in addition to a small fee, there is a form available from the SOS directly.

When a driver’s license is suspended in Illinois, their name goes into the National Driver Register (NDR) database. This means that every state can see their driving status, so obtaining a driver’s license in another state will not be possible. Another database is called the Driver License Compact (DLC), which records any traffic violations received by non-residents of the state. Drivers who commit infractions in other states might be penalized in their home state since the information is shared.

Drivers who are caught driving with a suspended license will likely be charged with a misdemeanor, fined, and possibly receive jail time. Felony charges are possible in some cases. The penalties depend upon the severity of the situation and the number of offenses by the defendant.

Some drivers may be eligible for a restricted license or Restricted Driving Privileges (RDP). RDP will usually allow the defendant to drive to work and school only or for medical purposes. If a defendant drives as part of their job, this might also be covered through RDP. Drivers are granted RDP based upon their driving record and circumstances surrounding their license suspension; RDP is not guaranteed and many drivers with suspended licenses must make other transportation arrangements. A hearing is required, and in most cases, the use of an attorney is highly recommended.

To reinstate a license, drivers will pay a reinstatement fee that is usually several hundred dollars, depending upon the suspension circumstances. For instance, a suspension based upon parking will cost less than one based upon a DUI conviction. If a license was revoked, the driver must apply for a reinstatement hearing before the Secretary of State. A skilled drivers license reinstatement attorney is a must. Many auto insurance companies will charge drivers higher premiums if they have a license suspension on their record.
