What To Do If You Are In An Auto Accident in Texas

Dealing with an auto accident can be stressful and confusing. There are some basic steps that need to be followed in the state of Texas if an accident occurs. Immediately following an accident, all parties involved should make sure that everyone is okay and administer any type of minor aid in the case of injury. If there are serious injuries, it is imperative that the appropriate medics and officials are called such as an ambulance, fire department, or police. In any case, authorities should be notified and all parties should share the following information: names, license plate numbers, auto insurance information, phone numbers, and vehicle descriptions. If there are witnesses to the accident, their information should also be collected. Every person involved in the accident should immediately write down, if possible, what happened while it is still fresh in their memory. The drivers should also note the condition of the road and any weather conditions. If the cars are damaged, tow trucks or other vehicle removal experts should be notified.

In Texas, drivers are required to file an official crash report with the Texas Department of Transportation if the accident results in injury, death, or property damage totaling more than a certain amount of money. The drivers should not delay as there is a time limit for filing the report and a tardy report could result in penalties. Even if police officers respond to the accident scene, the drivers should not assume that all of the official paperwork has been completed. They will need to file a report themselves and follow through on the process.

Understandably, many drivers are shaken up and upset after being in an auto accident. In most cases, it is best to consult an attorney to deal with the resulting legal paperwork and auto insurance ramifications. The cause of the accident will need to be determined, and drivers who are found to be at fault will especially need legal guidance. Drivers should usually not admit any responsibility for the accident until they have spoken with an attorney. Lawyers can also be very helpful if the driver or any passengers sustain injuries or lasting damages because of the accident. If any criminal charges are filed because of the accident, an attorney will be especially necessary.
